Jury asks to see IRS code book, Judge refuses to
let them see it.
After 3 full days of deliberation the jury sent a note to the judge
asking him to see the beat up, dog-eared, well read copy of
co-defendant Cindy Neun's IRS code book which had been shown to them
during the trial. They wanted to see Cindy's IRS code book and also a
"clean" copy of an IRS code book.
The judged absolutely denied their request saying that allowing the
jury to see the law would be "problematic".
With still no verdict rendered, the jury has been released for a three
day weekend and will be back to resume deliberations at 9:00 Monday
morning Las Vegas time.

willing, I would love to see you during the evening hours to listen to
you, to earn from you, and to hug you.

Yes, Peter, Irwin is very brave isn't he? And let's not forget
that
there are two other brave souls involved as well - Cindy Neun and Larry
Cohen.
You should have seen the look on the faces of each of the attorneys who
are defending Larry and Cindy (3 of them) as they informed us that
witnesses would not be allowed to testify. One had already been
threatened with contempt the week before, during the defense's first day
of presenting its case. Another had just been threatened with the
same.
As they explained that witnesses would not be allowed, their faces
appeared to me to be white, as if they had lost some blood in the
ordeal. They appeared to be shocked and outraged that a judge
would
(could) deny the appearance of defense witnesses. They explained
that
in this instance it was tantamount to not being allowed to establish a
record or put on any defense (Larry and Cindy did not testify).
One
commented that he had never, ever, seen this occur in all the years of
his lawyering as a criminal defense attorney.
This trial is illustrating what many have witnessed and have been
decrying for years about federal criminal tax trials. Let the
evidence,
facts and the law be thoroughly presented so that the chips may fall
where they may. That's not how it works in these trials.
Each of the defendant's long ago understood very well about the modern
hazards of federal tax trials. The "principled dedication" and
persistence of these folks is amazing and I salute them.
