Austin Bill of Rights Rally Speech

Thank you Michael Badnarik. Michael is the Texas Organizer/Activist of your Bill of Rights rallies. Today is the first one in Texas, of many, many more. The first one was December 15 past, on the 210th birthday of the signing of the Bill of Rights, in Denver, in front of a crowd of 250 at the Colorado state capitol grounds. I was arrested by the Denver police for demanding my guarantee, as a citizen of the United States of America, that the Second Amendment of the Bill of Rights be upheld and honored in Denver. It wasn't, as I knew it would not be, upheld or honored, by the employees with guns, of the Police State of Denver!

There are over 20,000 laws at every level of government, from municipal to federal, that violate Americans' guarantee, through the Bill of Rights, to keep and bear arms! There are hundreds of thousands of laws at all levels of government, that violate the other 9 guarantees/amendments of that so very important document - The Bill of Rights - so important, that our founding forefathers made it a part of the Constitution.

We believe the citizens of the United States and others who live in our country are in grave danger of being denied the inalienable rights that have made this country the best and brightest hope for the World for over 200 years. Many of our Rights have already been stolen and abuses have been visited upon U.S. Citizens, and other people across the world, at the hands of government agents acting in the name of our Nation.

We have a good system of government, but it needs to perform only its lawful functions and to be bound once again by the restraints of the U.S. Constitution and the Bill of Rights. We feel it is every U.S. citizen's duty to protect and defend these important documents, and ensure the guidelines it dictates are followed. There exist those currently in the U.S. government who would ignore its demands of restraint, fair and just legislation, strict division and limited scope of governmental powers. We feel it is every American's duty to elect and support those who take their oath to defend and protect the Constitution seriously and will stand by their promises.

The International Charter of Flag Etiquette states that a flag may be flown upside down in cases of extreme distress. We fly our flag upside down to call out to fellow Americans, and to make them aware that our country is in distress. We seek to inform our fellow citizens and spread word of the changes that are needed to ensure our Liberty.

Most of the lawmakers on Capitol Hill support laws that infringe our Rights on a daily basis. We are saying 'enough is enough;' we want the Bill of Rights and Constitution restored in America.

It is evident that our freedom is in grave jeopardy. This is proven not only by the actions of our Representatives and Senators, but by the actions of our Attorney General, John Ashcroft, who turned his back on the civil liberties of U.S. citizens and others. His calls for unconstitutional laws supposedly to combat terrorism in the wake of the horrific attacks on September 11, 2001 in NYC are nothing short of anti-freedom, dare we say, anti-American. He claimed to hold these values dear and to defend the Constitution. He lied to the American public. He seeks to take our freedoms away.

During this time of war and in an age of untold technical ability, we can't afford to allow any more infringements to occur. We must stand together, united, to demand our country, our Constitution, and our Bill of Rights are restored. We must keep our country safe from enemies, both foreign and domestic. Now more than ever we need the protections of the Constitution. Now more than ever we need to stand together and demand honor among our leaders. Together we can assure that liberty and the true spirit of America will prevail!

Join us in the Second American Revolution.

Join us each month, once a month, for a few hours to defend our Constitution, our Bill of Rights, and to demand the repeal of all unconstitutional laws at all levels of government.

So, what would prompt a mild-mannered guy like me to call out for a Second American Revolution?

Last April the supreme Court made a decision in the Atwater case. A woman, in Texas, was arrested because the police officer decided he could. He didn't like the fact that the woman's kids were not wearing seat belts. This is not an offense where you can do jail time, so Mrs. Atwater was upset that she was arrested. She and her vehicle were searched, she was taken to jail, her kids taken from her, and after spending time in jail, she had to post a bond to regain her freedom. The Fourth Amendment doesn't allow for illegal search and seizure. But, guess what? Once you are under arrest for something, anything, then the Fourth Amendment doesn't apply. Once under arrest, they can do with you as they please.

Mrs. Atwater thought this was a complete and total abuse of authority and violated her constitutional rights under the Fourth Amendment. She fought this all the way to the supreme Court, where she lost 5-4. Seems the justices think that police need more discretion as to whether or not the officer thinks you should go to jail. So, again, once you are under arrest, your Fourth Amendment rights don't apply, for an offense that -- if found guilty -- you couldn't go to jail.

The supreme Court found a way to circumvent the Fourth Amendment guarantee that Americans are not subject to illegal search and seizure. Tail light out, America? You can go to jail. Cracked windshield? You can go to jail. Why? Because John Law, who we all trust so much and who may be the moron who sat behind you in school, who so enjoyed tormenting you, gets to decide, to have discretion whether to arrest you or not. "Did you just give me lip, boy?" Off to Jail!

It was enough to convince me that something was seriously wrong with America. I had just settled an IRS audit that went on for four years and was one month from landing in federal court. Even though we supposedly had a new IRS that was fair, they decided to hit me with penalties, interest and more taxes to the tune of $355,000. They based this on what they thought, or let's call it, "What they decided" -- that my business is so proficient, that my profit margin was twice what I said it was. There is a lot more to this case that is very ugly, but this was the bottom line. By the time I was to go to court in January of 2001, the total was going to be over half a million. For the years '94, '95, and '96; over and above what I had already paid. My lawyers explained that I didn't even earn that much. I had never taken checks for the amounts they were talking, there was no money trail that said I had earned this money and the money was not in the business or my personal bank accounts. After 4 years of gut-wrenching discussions with the IRS, they decided to tell me that if I could show them from IRS test cases, that similar businesses in my field had profit margins like what my returns were asserting instead of the doubled profit margins decided upon by IRS examiners, well - they would drop the whole thing against me. We selected 7 cases from the IRS files similar to my business. All 7 showed profit margins within one to two percent of what I was claiming on my returns. Three weeks from trial, they reneged on what they had told me a week prior. "We still think you owe us money Mr. Stanley, give us $111,000 and the state $17,000 for a total of $128,000 and we will consider this matter closed."

I looked to my lawyer for advice and he said, "Rick, you have paid out $60,000 in 4 years for legal fees on this matter, next month you will pay me $100,000 more to go to a federal court, in front of an IRS judge, and the possibility always exists that you won't win and a $500,000 judgement and a $100,000 legal bill for a total of $600,000 will be due! What do you think you should do? Well, I settled. That part was easy. I sold my house and paid the government $128,000. I didn't owe them, and they knew it. Doesn't matter.

Over the years, I have watched this process with many, many others. People reach a goal of financial success, the government comes and takes it away. Unconstitutionally, I might add, but we will discuss that a little later. Join my boycott of the federal government. 63 million people did not file income tax returns in America that could have. Notice I said could -- not should. 123 million returns last year of which 15% were corporate returns. 285 million people in America. You can do the math as well as I can.

A voluntary tax means you don't pay if you don't volunteer to. In writing, tell your employer, that they are not authorized to deduct anything fom your paycheck (your labor) for the government and opt out America. Just say no -- stop paying.

What about roads? Gasoline taxes pay for all of that and than some.

What about all the government services? The treasury of the United States has admitted for decades that every penny from the income tax administered by the IRS goes for interest to the fed for the gang of 12 -- 12 international bankers who have administered our money supply since 1912, when the government gave up the right to control our money supply, unconstitutionally. That's right folks. I know they told you the federal reserve system is part of the US government. The international bankers who have controlled the world for the last 400 years control the federal reserve. From 1912 through 1972 they sucked the gold right out of your pockets, and Nixon took us off the last vestige of the gold standard in 1972. The constitutional gold standard - the standard set by our forefathers in the constitution, is sitting in European Banks.

Congress has the authority from Article 1, Section 8 of the constitution to levy and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States.

For 137 years, until 1913, the preceding method of taxation was constitutionally administered uniformly throughout the United States. That money is still collected the same way, and pays for federal government services. Our IRS income taxes pay the interest on the debt administered through the federal reserve. By the way, that is how the federal reserve administers the money supply, on the debt of Americans. Money for debt, interest paid in gold, by the sweat of American citizens in the form of taxes. The average American pays 54% of his wages for all of the various forms of taxes government dreams up, to seperate you from the fruits of your labor. The fruits of your labor guaranteed by the Declaration of Independence and by the Constitution. Stolen from you by an unlawful government that wants to steal your property and keep you toiling in slavery. A slavery where over 50% of your income is extorted from you by your government just so you can call yourself an American. Hopefully, the remaining 46% you get to keep covers the expectations of a good life, that you are working your butt off to acheive.

When that happens, let's not forget the IRS agent knocking on your door, anytime they want, to bring you back to reality.

Can't happen to you? You're honest? You are, and have been brainwashed. So was I.

Between January and April of 2001, these two separate matters happened in Colorado and Texas, and changed my life.

I decided to stop our government dead in its tracks, and return them to the confines of the constraints of the U.S. Constitution. My government, corrupt, fradulent, unconstitutional, unlawful.

Now, I do need to tell you that the Second American Revolution was very lonely at first. I believe that in time, millions of people will join us with our demands for good government.

My Second American Revolution needed a plan. Part 1 concerned doing something I detest. I don't like politicians. I decided that I would campaign to become the first Libertarian candidate to win a U.S. Senate seat. Get one citizen legislator at the federal level, more will follow. A huge requirement for me is to never compromise and vote for any legislation that violates the Constitution. This currently is done every day at every level of government. I envision being the conscience of the federal government. A very loud, boisterous and demanding conscience. One person can persuade many. That is the basis of my plan and requires unbending will and determination. My commitment and sworn oath is to defend the constitution -- and I will not be swayed, diverted, or paid off, from completing my sworn mission to replace our unconstitutional and corrupt aristocracy currently residing in government, with men and women who are defenders of liberty.

Davey Crocket was my favorite citizen legislature from Congress. One of his favorite admonitions to Congress was "Gentlemen, it is not our money to give." One of the few men to go to Washington, and still defend the pockets of Americans instead of lining his own. Davey Crocket was in the House of Representatives in the 1830's and is still an inspiration today. Another great man of integrity in the House was Louis T. McFadden. He served in the early 1930's. McFadden assailed the powers in government on May 23, 1933 when he brought formal charges against the board of governors of the Federal Reserve Bank system, the Comptroller of the Currency and the Secretary of the United States Treasury for numerous criminal acts, including but not limited to conspiracy, fraud, unlawful conversion and treason. The petition for Articles of Impeachment was referred to the judiciary committee in 1934 and has yet to be acted upon. It is available on the internet and I will make it available on my website in the near future at www.stanley2002.org.

He exposed the Federal Reserve for what it is, and had an attempt on his life by gun and again by poison. He survived both attempts only to succumb on October 3, 1936 to a very strange "heart failure sudden death" after a dose of "intestinal flu."

These were men of conscience -- Davey Crocket and Louis McFadden. Men to emulate. Men to study their words. Inspirational men that we can all aspire to be like. The question remains, "what will I do?" A question each must ask of ourselves, and only answer to themselves. History will judge us by what we do, or fail to do!

Part 2 of my plan for the Second American Revolution involved educating and mobilizing the American public to take action against an unlawful government. Shouldn't be hard. Uh-uh. But guess what? It is.

I picked a bad law, got arrested for it, and organized the Bill of Rights rallies to focus the American people upon the real problem of America. All of our problems in this country, stem from an unconstitutional government which is bent on the destruction of the principles on which this country was founded.

This is our fourth rally, each rally coinciding at high noon with other state's rallies. We have grown to 11 states now. Colorado has two separate rallies and working on three more locations so everyone can come to a rally somewhere in the state. Based on Austin, Texas this will be huge in the stand for freedom.

Part 2 of the plan is underway, and I believe will set a precedent for future generations to keep government in check.

Part 3 of the plan? Cut off the funding for the federal government. This government was supoenaed by "We the People," with a demand that the government respond in a recorded, public forum to our petition for redress of grievences regarding the fraudulent origin of the IRS and the unlawful administration and enforcement of the personal income tax system against American citizens after congressmen Roscoe Bartlett (MA), Assistant Attorney General Dan Bryant, and IRS commissioner Charles Rosotti broke their written agreement with the American people. They have betrayed the United States Constitution. The US Government was tried in absentia in Washington DC this past February 27th & 28th. Two days and 500 documents of evidence produced a guilty verdict regarding the unconstitutional IRS income tax. You will have to get the tape from givemeliberty.org to appreciate it fully. Cost $25. It is worth the cost to end your tax enslavement.

We will bring this government to its knees and we will ensure that the bonds of the Constitution will not be broken again.
