Yesterday on Fox News Judge Naplolitano was interviewed by John Gibson
and asked what the difference was between Houston and New Orleans
regarding looters and state laws. It was VERY INTERESTING to hear the
judge explain that, based on TEXAS STATE LAWS, it is VERY DIFFERENT!!
First, the judge said that under Texas law, a citizen that has a
firearm is obligated BY LAW to protect his neighborhood from looters
and not just to protect his own home. In other words, that citizen was
obligated to shoot looters, looting a neighbor's home, even when that
neighbor was evacuated!!
Second, the judge explained that under Texas law, ANY armed citizen can
shoot and kill a person coming onto their property to do harm to them,
their family or their property, in the case of looters.
Thirdly, and MOST IMPORTANT, he stated that under Texas law, it was
illegal to take a weapon from a private Texas Citizen that was not a
convicted criminal, as they did in New Orleans.
Both men laughed and agreed that looting in Texas ( Houston area for
example) wouldn't be a successful endeavor for anyone thinking of it !
