candidate Rick Stanley was convicted Thursday of openly
carrying a gun in defiance of a Denver city ordinance
during a December rally. The Denver County Court jury deliberated about two hours before delivering a verdict. Stanley admitted during testimony that he put a loaded Beretta .38-caliber semiautomatic handgun in his holster during a Dec. 15 rally at a downtown Denver park celebrating the Bill of Rights. Stanley contends that the Denver ordinance contradicts the Colorado Constitution and the Second Amendment of the U.S. Constitution, which he said grant permission to openly carry a weapon. "I had hoped there would be some champions for the Constitution on the jury," he said. "There were none." Stanley criticized the court system, calling it "fascist". "What I discovered was that the Constitution, in the city, county and district courts, cannot be used as a defense." Stanley, who plans to appeal his conviction, is using the county court charge to challenge the constitutionality of the ordinance. "We want to get it overturned and as quickly as possible," he said. He faces a maximum penalty of a year in prison and a $999 fine when he is sentenced July 25. Meanwhile, Stanley hopes to win the Libertarian nomination this weekend to oppose U.S. Sen. Wayne Allard and likely Democratic challenger Tom Strickland this fall. |
